1. Introduction
SkyKelpie Pty Ltd (ABN 47 655 966 813) ("SkyKelpie", "we", "us" or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, store and protect your personal information when you visit our websites, create an account, enrol in a course, use the SkyKelpie Aerial Stockmanship Course or any other services we offer (collectively, the "Services").
We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Where we collect personal information from individuals located in the European Economic Area, the United Kingdom or other jurisdictions with data protection laws, we also take reasonable steps to comply with applicable laws including the General Data Protection Regulation (GDPR) and UK GDPR.
By using the Services you consent to the collection, use and disclosure of your personal information as described in this Privacy Policy.
2. What personal information we collect
We may collect the following categories of personal information:
- Identity and contact information: name, email address, postal address, phone number, country of residence.
- Account information: username, password (stored in hashed form by the Platform), profile photo, biographical information you choose to provide.
- Transaction information: purchase history, order details, billing address, partial payment details (such as the last four digits of your card and card type — full payment card details are handled directly by our payment processors and are not stored by us).
- Course and learning data: courses enrolled in, lesson progress, quiz and survey responses, completion certificates issued, time spent on lessons, simulator activity.
- Community content: posts, comments, replies and other content you contribute to community forums or discussions.
- Communications: emails, support requests and other correspondence with us.
- Technical and usage data: IP address, device identifiers, browser type and version, operating system, referring URLs, pages viewed, clicks, session duration, approximate location derived from IP, and similar data collected through cookies and similar technologies.
- Marketing preferences: your subscription status and preferences in relation to our marketing communications.
We do not generally seek to collect sensitive information (such as health information, racial or ethnic origin, or political opinions). If sensitive information is reasonably necessary in a specific context, we will only collect it with your consent.
3. How we collect personal information
We collect personal information:
- directly from you when you create an account, make a purchase, contact us, complete a quiz or survey, post in the community forum, subscribe to our newsletter or interact with our Services;
- automatically when you use our websites or the Platform, through cookies, tracking pixels, server logs and similar technologies; and
- from third parties such as our payment processors, marketing platforms, analytics providers and the Platform provider, where we have a lawful basis to do so.
4. Why we collect and use your personal information
We use your personal information to:
- create and manage your account;
- provide you with access to courses, simulators and other content you have purchased;
- process payments, issue receipts and refunds, and prevent fraud;
- track your course progress and issue completion certificates;
- operate community forums and other interactive features;
- respond to your enquiries and provide customer support;
- send you service-related communications (such as receipts, account notifications and important updates);
- send you marketing communications about our courses, content, events and offers, where you have consented or where otherwise permitted by law;
- improve our courses, content and Services through analytics, testing and research;
- maintain the security and integrity of our Services and detect, prevent or investigate misuse;
- comply with legal obligations and enforce our Terms of Use; and
- any other purpose disclosed to you at the point of collection.
For users in the EEA / UK: our lawful bases for processing under the GDPR are typically: (a) performance of a contract with you (e.g. to deliver courses you have purchased); (b) compliance with legal obligations; (c) our legitimate interests (e.g. improving our Services, securing our platform, direct marketing to existing customers); and (d) your consent (e.g. for non-essential cookies and certain marketing communications).
5. Marketing communications
By creating an account or making a purchase, you consent to receiving marketing emails from us about SkyKelpie courses, content, simulator updates, events and related offerings. We rely on your consent and (in Australia) the inferred-consent provisions of the Spam Act 2003 (Cth) where applicable.
You can opt out of marketing communications at any time by:
- using the unsubscribe link in any marketing email;
- updating your preferences in your account settings; or
- emailing [email protected].
We will continue to send you essential service communications (such as receipts, account notices and material changes to our terms) regardless of your marketing preferences.
6. Cookies and similar technologies
We and our service providers use cookies, pixels, tags and similar technologies to operate the Services, remember your preferences, analyse usage, and (where applicable) deliver advertising. These include:
- Strictly necessary cookies required for login, security and core platform functionality;
- Analytics cookies (including Google Analytics 4) to understand how users interact with our Services so we can improve them; and
- Marketing and advertising cookies and pixels (including the Meta Pixel) to measure the effectiveness of our marketing and to show relevant ads on third-party platforms.

7. Disclosure of personal information to third parties
We disclose personal information to the following categories of third parties for the purposes set out above:
- Platform provider: Thinkific Labs Inc. (Canada) hosts our courses and stores course-related personal information.
- Payment processors: Stripe and similar processors handle payment card data and process transactions on our behalf.
- Email and marketing platforms: our email service providers and customer relationship management tools, used to send service and marketing communications.
- Analytics providers: Google (Google Analytics 4) and similar providers, who help us understand usage patterns.
- Advertising platforms: Meta (Facebook/Instagram) via the Meta Pixel, and similar platforms, for measurement and remarketing.
- Video hosting and conferencing providers: including Zoom and similar providers used for live sessions or hosted video.
- Professional advisers: our accountants, lawyers, insurers and auditors, where required.
- Government and regulatory bodies: where required by law, court order or to enforce our legal rights.
- Successors in business: in the event of a sale, merger, restructure or insolvency, your personal information may be transferred to a successor entity.
We require our service providers to handle personal information consistently with applicable privacy laws and only for the purposes for which we engage them.
8. International transfers of personal information
Because our Platform provider, payment processors, analytics providers and other service providers operate in countries including Canada, the United States and the European Union, your personal information may be transferred to, stored in and processed in countries other than the country in which you reside.
By using the Services, you acknowledge and consent to the transfer of your personal information to these countries, which may have data protection laws different from your own. Where required by law, we put in place appropriate safeguards (such as standard contractual clauses) for transfers from the EEA/UK to other jurisdictions.
9. Data security
We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure. These steps include encryption in transit, access controls, secure password storage by our Platform provider, and contractual obligations on our service providers.
No method of transmission or storage is completely secure. While we strive to protect your personal information, we cannot guarantee absolute security and you provide your personal information at your own risk.
10. Data retention
We retain personal information only for as long as is reasonably necessary for the purposes for which it was collected, to comply with our legal, accounting and tax obligations, to resolve disputes and to enforce our agreements.
Account, course progress and certificate data is generally retained for as long as your account remains active and for a reasonable period afterwards. Transaction records are typically retained for at least seven years to meet Australian tax and corporate record-keeping requirements. When personal information is no longer required, we take reasonable steps to destroy or de-identify it.
11. Your rights
11.1 Australian users
You have the right to request access to and correction of the personal information we hold about you. To make such a request, please contact [email protected]. We will respond within a reasonable period, generally within 30 days.
11.2 EEA, UK and other international users
If you are located in the EEA, UK or another jurisdiction with similar laws, you may have additional rights, including the right to:
- access your personal information;
- have inaccurate personal information corrected;
- request erasure of your personal information ("right to be forgotten");
- restrict or object to certain processing;
- data portability (receive your data in a structured, commonly used format);
- withdraw consent where processing is based on consent; and
- lodge a complaint with your local supervisory authority.

12. Children
The Services are not intended for, or directed at, children under the age of 18. We do not knowingly collect personal information from anyone under 18. If you become aware that a child has provided us with personal information, please contact us so that we can delete it.

We may update this Privacy Policy from time to time. The "Last updated" date at the top reflects the current version. Where changes are material we will use reasonable efforts to notify you (for example by email or through the Platform). Continued use of the Services after changes take effect constitutes acceptance of the updated Privacy Policy.
